Welcome to wrybe.com (“wrybe”, “we”, “us”). These Terms & Conditions (“Terms”) govern your access to and use of our platform, including associated websites, applications, modules, and services (the “Services”). By creating an account or using the Services, you agree to these Terms.
If you do not agree, please do not use the Services.
1. Who we are and what we provide
The Services are provided by Wrybe, Inc., a Delaware corporation (“Company”). wrybe is a web application that helps users build, manage, and operate websites and web apps, including (without limitation): user authentication (which may be invitation-only), site/page management, file and asset handling, region/data residency preferences, domain purchase/management, AI-assisted content utilities, and billing/subscriptions.
2. Eligibility and accounts
- Invitation-only: New registrations may require a valid invitation code (where enabled).
- Age: You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian to use the Services, and that they agree to these Terms on your behalf.
- Accurate information: You agree to provide accurate information and keep it up to date.
- Security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
3. Acceptable use
You must use the Services lawfully and responsibly. Prohibited conduct includes: uploading malware; attempting unauthorised access; violating intellectual property rights; sending unsolicited or unlawful communications; or using the Services to host or distribute illegal, harmful, or deceptive content. We may suspend or terminate access where we reasonably believe these Terms are violated.
When creating websites or web apps on wrybe.com, the following are not allowed:
- Pornography
- Adult Content
- Escort Services
- Violence
- Illegal drugs
- Self-Harm & Suicide
- Child Exploitation
- Extremism & Terrorism
- Malware & Cybercrime
4. Content and intellectual property
- Your content: You retain ownership of content you upload. You grant us a non-exclusive, worldwide licence to host, reproduce, display, and process your content solely to provide, maintain, secure, and improve the Services.
- Our content: The platform, code, design, and trademarks are owned by us or our licensors. You may not copy, modify, reverse engineer, or re-distribute except as expressly permitted by law or with our written permission.
5. Regions and data residency
Where region selection is available, we will use commercially reasonable efforts to store and process primary service data within the region you choose. Some processing (e.g., security logging, abuse prevention, support operations, CDN caching, and payments) may occur outside the selected region as reasonably necessary to provide and protect the Services.
6. Privacy, data use and cookies
- Privacy: Our collection and use of personal information are described in our Privacy Policy.
- Cookies: We use cookies and similar technologies for authentication, security, and product performance. You can manage cookies via your browser settings; disabling some cookies may impact functionality. See our Cookie Policy.
- International processing: Your information may be processed in countries other than where you live. We take reasonable steps designed to protect information consistent with our Privacy Policy and applicable law.
7. Third-party services and domains
The Services may integrate with third-party providers (e.g., domain registrars, CDNs, analytics). Third-party terms may apply, and fees may be passed through. For domain purchases, you authorise us to act as your agent with registrars and to share necessary information for provisioning and compliance. Registrar policies (including WHOIS, privacy protection options, renewals, and redemption fees) apply.
8. Third-party services
To operate and secure the Services, we rely on trusted third-party service providers (such as hosting, payments, security, and AI providers). Details about these providers and how personal data is processed are described in our Privacy Policy.
9. Plans, billing and taxes
- Fees: Some features require paid plans or usage-based fees. Prices and inclusions will be shown in-app or via invoice.
- Billing: You agree to pay charges when due. Unless stated otherwise, amounts are shown in the currency presented at checkout or in your account billing UI. Taxes may be added where required by law. Late or failed payments may result in suspension.
- Changes: We may change prices or plan inclusions with reasonable notice. Changes take effect in your next billing period unless otherwise stated.
10. Fair use, abuse prevention and resource limits
- Reasonable usage: Plans include reasonable usage limits designed to support normal, intended use of the Services.
- Platform stability: Limits help protect platform performance, reliability, and other users.
- Resource scope: Limits may apply to compute, storage, automation, requests, or other resources used within the Services.
- Enforcement: We may enforce limits by throttling, queuing, or temporarily restricting usage to prevent abuse and maintain stability.
- Changes over time: Limits may change as the Services evolve, with reasonable notice where practicable.
11. Trials, cancellations and refunds
Where offered, trials are for evaluation and may be changed or withdrawn. You may cancel at any time; cancellations take effect at the end of the current billing period unless stated otherwise. Refunds (if any) are provided as required by applicable law and our posted refund practices (if any).
12. Service availability and changes
We aim to provide reliable Services but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features (with reasonable notice where practicable) to improve the platform, address security risks, or comply with law.
13. Disclaimers and limitation of liability
- To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind (express, implied, or statutory), including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, goodwill, or data, arising from or related to the Services.
- To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the greater of: (a) the amounts you paid us for the Services in the 12 months before the event giving rise to the claim; or (b) USD $100.
- Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In that case, our liability will be limited to the maximum extent permitted by applicable law.
14. Suspension and termination
We may suspend or terminate access if you breach these Terms, if required by law or regulator, for non-payment, or to address security, fraud or system integrity risks. You may terminate at any time by closing your account (where available) or contacting support.
15. Communications and notices
You consent to receive service-related communications electronically (e.g., in-app messages, email). Notices are deemed delivered when sent to your registered email address or displayed in the application.
16. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for disputes arising out of or relating to these Terms or the Services, except where applicable law provides otherwise.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified within the Service or via email. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
